11. What are the licensing consequences if I take the BAC test or refuse the test?

The administrative action is as follows:

.08 Adult or .02 Juvenile BAC test

-For a first incident within 7 years, suspension or denial for ninety days;

-For a second or subsequent incident within 7 years, revocation or denial for two years or until the person reaches age twenty-one, whichever is longer in the case of a juvenile.

Refusal to take the test

Under RCW 46.20.308, you have the right to refuse a BAC test. If you refuse however, your license will be suspended as follows:

-For a first refusal within 7 years, revoke the license for one year.

-For a second or subsequent refusal within 7 years, or for a first refusal where there has been one or more previous incidents within 7 years that have resulted in administrative action under this section, revocation or denial for two years or until the person reaches age twenty-one, whichever is longer.

In most cases, it is better to take the BAC test.
